Lewisville Scrivener's error
Proposal
Clark County Community Planning is requesting an amendment to the Comprehensive Growth Management Plan and Zoning maps to add a Surface Mining Overlay to a 1.2 acre parcel (225923000) to correct a scrivener’s error that removed the Surface Mining Overlay.
Background
On October 21, 2021 staff received an inquiry from the Lewis River Ranch, LLC representative regarding a potential scrivener’s error on parcel 225923000. The property is 1.2 acres of an approximately 350 acre Lewisville mining site.
Planning and GIS staff reviewed maps from 1994 to present (Exhibit 1) and confirmed that the Surface Mining Overlay (SMO)1 had been applied to the property in 1994 consistent with the requirement of the Growth Management Act to identify resource land. The SMO was applied to the property until 2014, when the County was reviewing and updating the SMO countywide. Exhibit 2 of RES2014-12-08 contains a map of all of the SMO amendments approved by Council. The exhibit does not show any changes near the Lewis River Ranch property. Exhibit 2a of RES2014-12-08 includes a table summarizing the proposed SMO map changes and there is no mention of a proposed amendment on Lewis River Ranch property. There have been no requests to de-designate or amend the mineral resource designation on the property since its designation in 1994.
