SYNCHRONOUS FULL COVENANT RELEASE

Project Summary

The applicant requests the full release of a site-specific restrictive covenant on two adjacent parcels (195971005 and 195971010) to allow for the full use of the property in conformance with the current Rural Commercial (RC) comprehensive plan designation and Rural Commercial outside of Rural Center (CR-1) zoning district.

Background

The parcels total two acres in area and are located at the southwest corner of NE 179th Street and NE 72nd Avenue in unincorporated Clark County. The parcels are currently designated Rural Commercial (RC) in the comprehensive plan and are within the Rural Commercial outside of Rural Center (CR-1) zoning district. The two adjacent one-acre parcels are developed with private professional office buildings. The surrounding uses consist of the tractor equipment business to the north, the church to the northwest, the grange to the east, and rural residential to the southwest.

A “Covenant Running with the Land” was executed in 1980 between the county and prior owners of the properties which stated, “the use of the SITE will be limited to bank uses indicated on the revised preliminary site plan…” Further, the covenant stated that, “the provision of this covenant may be modified or rescinded only upon execution of an appropriate written instrument by the Board of Clark County Commissioners…” The purpose of the original 1980 covenant running with the land was to limit commercial use on the site to the “bank use” as part of the zone change to commercial, but to not allow other commercial uses.
