Shoreline Master Program Amendments (CCC 40.460)

Project Summary

This is a proposal to amend the Shoreline Master Program (SMP) Chapter 40.460 Clark County Code.  

Background

The Shoreline Management Act (SMA) was passed by the legislature in 1971 in response to a citizen initiative to protect shoreline resources. The SMA provides an overarching framework of goals and policies which emphasize water dependent uses, environmental protection and public access. Implementation of the SMA is through local Shoreline Master Programs, developed and adopted locally, approved and adopted by the state Department of Ecology (Ecology).

Clark County adopted its first SMP in 1974 and completed a comprehensive update to the SMP in 2012. The most recent batch of amendments to the SMP took place as part of a state mandated periodic review that became effective in April 2021. SMP policies are included in Chapter 13 of the Clark County Comprehensive Growth Management Plan 2015-2035 (Comprehensive Plan). SMP regulations are included in Clark County Code Chapter 40.460. There is also a Shoreline Designation Map in Appendix B of the Comprehensive Plan.

Local governments may make amendments to their shoreline programs to reflect changing local circumstances, new information or improved data per Washington Administrative Code (WAC) 173-26-090.

The proposed changes at this time are recommended to 1) align with updates to critical areas code in other chapters of Title 40, 2) address inconsistencies between the county shoreline code and Shoreline Management Act as discovered by staff during implementation, and 3) to incorporate updated information.
